New state building norms of urban development, namely, DBN B. 2.2-12:2018 "Planning and building of territories", are valid and continue to operate, despite the resistance and planned a campaign against joining them in action.
This said the Deputy Minister of regional development, construction and housing and communal services of Ukraine Lev Partskhaladze.
"Recently, the Sixth appellate court cancelled all previous decisions on appeal, and the new SNIP "Planning and building of the territories" and recognized as invalid the order of Ministry of regional development №100 about the approval of the DBN, but not DBN themselves. So I want to clarify the situation. The recognition of this order is invalid does not affect the power of the GOS themselves. The order is just a technical tool, which approves and gives the start to publish the state building code, after which they enter into force in accordance with the law and can't be stopped in another way. This is an irreversible process and therefore, the action of these SNIPS is not suspended even for a moment. Attention everyone who somehow tries to neutralize these positive changes in the industry – DBN B. 2.2-12:2018 "Planning and building of territories" are active and continue to act!" he said.
Partskhaladze said that the Ministry of regional development while continuing to protect the safety and comfort of the people in all instances, in particular, is preparing to submit the cassation. Because the new requirements against the entry which was planned this campaign, with more than 50 fundamental qualitative changes to improve people's lives. In particular, it introduced:
— a restriction on the height of buildings in cities – the new concept of "blue line";
— limit construction in green zones – the new concept of "green lines" that define the boundaries of the landscape
and recreational areas, on which construction is prohibited;
— limit the building density, which prevents its increase by several times;
— required the construction of kindergartens and schools in residential areas;
— increased areas for recreation and sport in residential areas;
— mandatory provision of barrier-free access and other important changes.
In addition, continuing revision and updating of town-planning norms. Therefore developed a new version of these DBN, which was further considered important problematic issues and proposals up to current standards. This is done by the Ministry of regional development jointly with the Ukrainian state scientific-research Institute of urban design "Dipromisto" named after Y. Belokon and with the active participation of specialists, experts and the public. By order of the Ministry No. 104 of 26 April 2019, issued on 27 June this year in the Information Bulletin of the Ministry No. 6/2019, was approved a new edition of DBN B. 2.2-12:2019 "Planning and building of territories". "In accordance with the established legislation the procedure of DBN B. 2.2-12:2019 "Planning and building of territories" shall enter into force on the first day of the month that occurs 90 days from the date of publication. That is, from October 1 this year. Also let me add that we will continue to improve these standards, because the safety and comfort of people – the most important thing" – said Partskhaladze.

It should be noted - SNIP "Planning and building of territories" was developed to replace the previous building regulations governing urban planning, which operated since 1992.
A few days before the entry into force of these important state in the District court of the city of Kiev was registered a number of lawsuits aimed at the recognition illegal and invalid the order of Ministry of regional development, approving the specified DBN. On the action of the GOS themselves are not affected, they began to operate from 1 September 2018, and continue to act now.
