The cost of real estate valuation in Ukraine in 2017

Valuation of real estate is made exclusively by specialists who are required to make an assessment in writing. In some cases, real estate transactions can be declared invalid without a preliminary assessment of the subject of the contract.
Residential and non-residential real estate in Ukraine is subject to assessment - the determination of the value of the object by appraisers or subjects of evaluation activities.

Who has the right to evaluate real estate in Ukraine

The appraisal of the immovable property is carried out by appraisers and market participants who received a special certificate and entered into the State Register of Appraisers and Valuers. This register is placed on the electronic resource of the state property fund. Access to the register is free, so a citizen who wishes to order an appraisal service can contact the appraiser himself using the contact information on the site.

Also, the owner of real estate, which wants to challenge the appraiser's decision, can use the provisions of the Law of Ukraine No. 2658-III "On the valuation of property, property rights and professional appraisal activities in Ukraine". Legal standards provide for a review of the report on the valuation of real estate. Such a service is not limited in the amount of provision but is provided on a fee basis.

The review can be carried out by:
  • appraisers with at least two years of experience in the field of property valuation;
  • Appraisers who work in the State Property Fund of Ukraine, with at least two years of experience in the field of property valuation;
  • Expert councils created by self-regulating organizations of appraisers.
When you need a property evaluation

The evaluation of real estate is carried out at the request of the owner of the property. The legislation provides for cases (described below) when it is necessary to conduct an assessment of real estate.

  1. If there is an alienation of immovable property or another operation with real estate that is subject to taxation, it is necessary to confirm by documents the value of the real estate object.
  2. In accordance with the provisions of the Tax Code of Ukraine, preliminary assessment of the object when it is necessary to conclude a contract of sale or exchange of an apartment or a private house. A notary who must certify such transactions cannot sign a contract between individuals unless a written report on the availability of an appraisal of the value of real estate is provided. For example, the tax on income from the sale of real estate is calculated based on the price that is specified in the contract. This amount cannot be lower than the estimated value of the object. The tax on the sale of the apartment will be paid from the amount that is higher - the price in the purchase or appraised value of the property.
  3. Evaluation of real estate is needed at the time of concluding a real estate lease contract, which is in municipal or state property and when privatizing real estate.
When valuing a property is not necessary

In these situations (described below), it is possible to assess the apartment or house, but the lack of an evaluation report is not considered an offense.
  1. When a lease contract for immovable property that is privately owned, the document indicates the value of the property, but an official property valuation report is not required.
  2. In the case of obtaining property in the inheritance by relatives of the first degree of kinship (spouse, spouse, parents, children), the income tax is not levied and the property is valued. With the adoption of the Law of Ukraine No. 0940 of 27.11.2014 "On Amendments to the Tax Code of Ukraine on the Taxation of Inheritance and the Clarification of Certain Provisions", heirs of the second degree of kinship are also exempt from paying income tax and, accordingly, the work of assessing the immovable property inherited.
  3. When the transfer of real estate under a charitable agreement occurs, the closest relatives, as well as in case of acceptance of the inheritance, do not pay income tax and are exempt from the valuation of the received real estate.
  4. By concluding an agreement on the transfer of immovable property as collateral, the parties can agree on an assessment of the subject of the pledge. Also, to determine the amount of the insurance amount for insurance, the owner of the property can order an evaluation service from the subject of the evaluation activity.
In all other cases, when a zero rate on income from the receipt of real estate does not work, it is necessary to conduct an appraisal of real estate.

How to find a real estate appraiser

To order an appraisal of real estate, you need to contact a certified appraiser. You can use the services of a company that specializes in real estate valuation or select a specialist on the electronic resource of the State Property Fund, where appraisers from all regions of Ukraine are registered.

For the purpose of the valuation, the customer presents the appraiser such documents:

  1. The document proving the identity of the customer (passport).
  2. Documents confirming ownership of immovable property (contract of sale, exchange, gift, certificate of ownership, state act on ownership of land).
  3. Technical passport of BTI.
Evaluation of a residential house provides for an assessment of the entire land plot on which the building is located. In addition to the documents listed in the list, the customer needs to prepare documents confirming the right to own a piece of land.

Real estate valuation algorithm

Real estate valuation should be carried out in accordance with the provisions prescribed in the National Standard No. 2 "Valuation of immovable property" approved by Resolution No. 1442 of the Cabinet of Ministers of Ukraine of 28.10.2004 and National Standard No. 1 approved by Resolution No. 1440 of the Cabinet of Ministers of Ukraine of 10.09. 2003. 
Proceeding from the norms of clause 50 of the National Standard No.1 before the independent valuation of the property, the appraiser should familiarize himself with the object of evaluation. Article 11 of the Law of Ukraine No. 2658-III "On the valuation of property, property rights and professional appraisal activities in Ukraine" states that the owner of the real estate must grant access to the evaluation object in order to obtain reliable information by the evaluator.
Based on the results of the assessment, the real estate appraiser presents a report on the valuation of the property, which indicates its value. The report is signed by the real estate appraisal manufacturer and is signed by the head of the enterprise.
The appraiser submits information from the property valuation report that is drawn up for tax purposes to the State Property Fund for entering data into a single database of evaluation reports. Only the notaries and subjects of the appraisal activity can use the data in the database.

What affects the cost of the object

The criteria for assessing residential real estate are:
  • location of the assessed object (center or remote areas from the center);
  • nearby infrastructure (next to the park or vice versa, wasteland or industrial zone). And also the location of a store, a polyclinic, a school, a kindergarten; transport interchange;
  • type of house (Stalin building, individual construction or other);
  • materials used in the erection of buildings and ceilings;
  • The presence of an elevator and intercom;
  • the general state of the object itself. The cost will increase if there is a balcony in the apartment; built-in furniture, alarm. Also, when assessing the value of the state of each room separately and the quality of the repair in the housing. The final evaluation of the value of real estate depends on the situation on the market and the current prices for similar properties. The valuer studies prices in the market and, based on the information received, forms the value of the object.
Cost of real estate valuation

The price of real estate valuation services is negotiated and determined during negotiations between the parties (the customer and the executor). The cost of services is indicated in the written agreement on the valuation of the property.

How long does real estate valuation work?

The validity period of the real estate appraisal report is limited in time. The evaluator himself specifies the period of time during which the assessment made by him will be valid. This period cannot exceed six months, the counting that begins with the signing of the report on the valuation of real estate. When the statute of limitations expires, it is necessary to reassess the real estate.
