The Ministry of regional development, construction and housing and communal services of Ukraine jointly with the state enterprise "research and design Institute of urban development" developed a draft law "On the protection of the rights of individuals-depositors in the construction of blocks of flats".
This was announced by Deputy Minister of regional development, construction and housing and communal services of Ukraine Leo Partskhaladze.
"Today in Ukraine there are no legislative mechanisms for the completion of distressed residential properties, which were built with the involvement of funds of individuals-depositors. As there are no common information regarding these problematic objects and people who invested in their construction. According to approximate statistics, the depositors 120 protracted in Ukraine were left without funds and without a new home. And this problem is very necessary to solve. Therefore, we developed a bill that aims to resolve this issue and provide an effective mechanism for the completion of those residential facilities in which people are invested and which have not been put into operation in a certain period of time," he said.
Therefore, this bill is aimed at ensuring the completion of the apartment houses which are under construction with attraction of means of physical persons-depositors and not taken in operation in a certain contract on attraction of funds in the construction period.
A draft law introduces an effective mechanism that is able to ensure the completion of construction of problem objects in Ukraine through the introduction at the legislative level:
- recourse of investors in the local authorities in case of violation of the period for acceptance of the facility by more than one year;
- the possibility of implementation by local governments of powers on formation of the list of problem objects and the adoption of measures for their completion, as well as of the organization meeting of the investors for the adoption of the relevant decision;
- the possibility of conducting a competition to select a new customer, which will complete the completion of problem object;
- economic incentives for the completion of the new customers and possible sources of funding completion.
A draft law has been sent to the concerned Central bodies of Executive power, and then will be finalized and submitted to the Cabinet of Ministers of Ukraine.
